AI Content & Image Generation Policy

This AI Content & Image Generation Policy ("Policy") governs the creation, ownership, and use of AI-generated images and AI-polished text produced through the SplashStreet platform (the "Service") operated by Tradebooks Pro LLC ("Company," "we," "us," or "our"). This Policy supplements our Terms of Service and Privacy Policy.
1. Scope
This Policy applies to all content generated through the Service's AI features, including:
- Promotional images created using OpenAI's image generation technology (gpt-image-1.5)
- Campaign text polished or refined using AI language models (gpt-4o-mini)

2. Ownership & Rights
- Company Ownership: All AI-generated images created through the Service are the property of Tradebooks Pro LLC. The Company retains full ownership of all generated images, including the right to use, reproduce, modify, distribute, display, and create derivative works from any image generated on the platform.
- Your License: You are granted a perpetual, non-exclusive, worldwide, royalty-free license to use images generated through your account for your business and personal purposes. This license includes, but is not limited to, use in SMS campaigns, social media, print materials, in-store displays, merchandise (t-shirts, stickers, mugs, banners, etc.), and any other lawful purpose.
- Company Use: The Company retains unrestricted rights to use any image generated on the platform for marketing, portfolio display, style library curation, documentation, feature demonstrations, promotional materials, and any other business purpose, without notice or compensation to you.
- Copyright Notice: Images generated solely by artificial intelligence may not be eligible for copyright protection under current United States law. The U.S. Copyright Office has indicated that works created without sufficient human authorship may not meet the threshold for copyright registration. You acknowledge this limitation when using AI-generated images. Human editing, selection, and arrangement of AI-generated elements may establish copyrightable contributions — we recommend documenting your creative process if you intend to seek IP protection.
- License Survival: Your license to use images you have downloaded survives cancellation of your subscription. Images you did not download before the end of your retention period remain Company assets.
3. Commercial Use
- You may use images generated through the Service for any lawful commercial purpose within the scope of your license.
- There are no restrictions on commercial use beyond those imposed by applicable law and this Policy's prohibited content rules.
- You bear all liability for the commercial use of images generated through your account, including any intellectual property claims that may arise.
- We recommend that businesses not rely on unmodified AI outputs as their sole flagship brand assets, given the evolving legal landscape around AI-generated content.
4. Prohibited Content
You may not use the Service to generate images that depict, contain, or promote:
- Realistic depictions of real, identifiable individuals without their express consent
- Deepfakes or manipulated likenesses of any person
- Copyrighted characters, logos, or branded content (e.g., Disney characters, Nike swoosh, sports team logos)
- Content that mimics the distinctive style of specific living artists
- Named public figures or celebrities
- Sexually explicit or pornographic content
- Graphic violence, gore, or shock content
- Hate speech, discriminatory imagery, or symbols of hate
- Political misinformation or deceptive imagery intended to mislead
- Content designed to harass, intimidate, or bully any individual or group
- Content promoting illegal activities
- Content that targets, depicts, or exploits minors in any way
This list is not exhaustive. We reserve the right to determine, at our sole discretion, whether content violates this Policy.
5. Content Moderation
AI-generated content on SplashStreet is subject to multiple layers of review:
- OpenAI Safety Filters: OpenAI's built-in content safety systems automatically evaluate prompts and generated images, blocking requests that violate their usage policies. These filters serve as the first line of defense against prohibited content.
- Platform Review: We reserve the right to review any content generated through the Service for compliance with this Policy. We are not obligated to proactively review all generated content, but may do so at our discretion.
- Enforcement: Repeated generation of content that violates this Policy, circumvents safety filters, or results in complaints may lead to suspension or permanent termination of your account.
6. AI Metadata & Transparency
- Images generated through OpenAI's API include C2PA metadata (Coalition for Content Provenance and Authenticity) that identifies them as AI-generated. This metadata is embedded in the image file by OpenAI at the point of creation.
- SplashStreet does not remove or modify AI provenance metadata from generated images.
- You should be aware that AI-generated images may be identifiable as such through metadata inspection tools and AI detection services.
7. Data Handling for AI Generation
When you generate images or polish text through the Service, the following data is sent to OpenAI:
- Your business name and business type
- Promotional text and campaign copy
- Visual hints and style preferences
The following data is never sent to OpenAI:
- Contact phone numbers or email addresses
- Customer names or personal information from your contact lists
- Payment or billing information
Per OpenAI's current API terms, data submitted through the API is not used to train their models. Generated images are stored in Firebase Storage under your business account and in the Company's image archive.
8. AI-Polished Text
- Campaign text may be polished or refined using AI language models (gpt-4o-mini) to improve clarity, tone, and marketing effectiveness.
- All AI-polished text is presented to you as a suggestion. You review and approve all campaign text before it is sent to any recipient.
- You are solely responsible for the final content of your messages, regardless of whether AI polishing was used.
- The same data isolation applies — no contact information or personal data from your contact lists is sent to OpenAI during text polishing.
9. Limitation of Liability for AI Content
- AI technology may produce unexpected, inaccurate, or unsuitable content. Generated images may contain artifacts, errors, or unintended elements.
- You are solely responsible for reviewing all generated content before use in any campaign, publication, or commercial application.
- Tradebooks Pro LLC is not liable for any claims, damages, or losses arising from your use of AI-generated content, including intellectual property infringement claims, defamation, rights of publicity violations, or regulatory penalties.
- We do not warrant that AI outputs are free of errors, artifacts, or unintended content.
- We do not provide indemnification for claims arising from your use of AI-generated images or text.
- Information provided through the Service about copyright, intellectual property, AI provenance, and regulatory matters is for informational purposes only and does not constitute legal advice. Consult a qualified attorney for legal guidance specific to your situation.
10. Changes to This Policy
We may update this Policy as AI capabilities, industry standards, and the legal landscape evolve. Material changes will be posted on this page with an updated "Last updated" date. Continued use of the Service's AI features after changes constitutes acceptance of the updated Policy.
